UPDATE July 21, 2014:  SETTLED for $2.75 million. The New York Times reports:
"New York City has agreed to pay $2.75 million to settle a lawsuit stemming from the December 2012 death of a prisoner at Rikers Island after he suffered what the city medical examiner’s office concluded was “blunt force trauma” to the head. The inmate, Ronald Spear, 52, had kidney problems and walked with a cane, according to the lawsuit. The medical examiner’s office ruled that the manner of death was homicide."

On the afternoon of Dec. 19, 2012, Nellie Kelly's phone rang. The caller identified himself as an inmate on Rikers Island, and told her he had some bad news about her brother, Ronald Spear. The inmate's name was Jesse James. He was 29, and had been awaiting trial since September in the jail known as the North Infirmary Command. James told Kelly that her brother was dead.

"He says, 'You don't know me, but I know your brother, I'm so sorry, they killed your brother today,'" Kelly tells the Voice.

Knowing that Ronald had serious heart and kidney ailments and had complained repeatedly about the quality of Rikers medical care, she said, "How? Was it the wrong medicine?"

"No," James replied. "They beat him to death."

Spear, 53, died at around 4 a.m. on Dec. 19, Correction officials say. The city medical examiner autopsy is still not completed, and the cause of death is currently listed as, "circumstances undetermined pending police investigation."

Some in the Correction Department have attributed Spear's death unofficially to some kind of medical disorder. The preliminary account is that Spear tried to leave the medical unit where he was housed, and when a guard stopped him, he struck the guard with his cane.

Correction staff then "restrained" him and he died as a result of his illness. Spear, the sources say, was a troublesome inmate who often refused dialysis treatment.

That account, however, flies in the face of what the Voice has learned over the past 10 days. For one thing, relatives of Spear and sources tell the Voice that autopsy photos appear to depict bruising on his face--suggesting some kind of serious physical altercation.

"There's a mark under his left eye, his ribs seemed to be protruding on his left side, and on his shoulder, you could see three marks, possibly bruises," Kelly says. "There don't appear to be any defensive wounds on his hands which mean to me he wasn't fighting anyone."

Last week, Correction Department spokesman Matthew Nerzig said the agency had "received no complaint involving this inmate from Legal Aid or elsewhere."
However, soon after Spear reached Rikers, he began having issues with his medical care. Instead of filing an inmate grievance, which he evidently did not believe would do any good, he complained repeatedly to Legal Aid's Prisoners Rights Project, which sent a series of emails to the Correction Department, sources said. (Medical care on Rikers is handled by a private contractor.)

On Sept. 26, PRP lawyers reported he was complaining that he had not been taken to dialysis for a week. A day later, he reported that doctor stopped his medications and threatened to take them away for good. On Nov. 20, PRP warned Correction officials that Spear needed frequent dialysis and medications. And on Dec. 18, one day before Spear died, PRP lawyers again begged the agency to intervene to get him his dialysis.

"Our office expressed repeated concerns about the adequacy of his medical care, and we have been informed that he suffered traumatic injury when struck by correction officers, injuries which post-autopsy photos appear to document," says Jonathan Chasan, a lawyer for the Prisoners Rights Project, declining further comment.

In November, one month before his death, Spear was angry enough about his medical treatment that, on his own, he filed a lawsuit in federal court. In the lawsuit, he alleges that a doctor Ramos and a nurse Bowen got angry when he refused to use the Rikers dialysis machine and stopped his medications "to force me to use the machine."

Spear demanded a court order returning his medications to "stop my pain and rid my body of excess water and maintain a normal blood pressure reading." "I am seeking $2 million because my blood is not cheap," he added.

Then, in a line that now could be tragically prophetic, he wrote, "Due to the fact that Dr. Ramos has stopped all my pain medications, he has caused me severe pain. And now that the Prisoners Rights Project is involved, I have correction officers retaliating against me."

My heart goes out to Ms. Kelley and her family. Spear's brother became my Facebook friend today despite CoIntelPro interference. The prison industrial complex apparently objects to their victims' families communicating with each other. My brother was secretly arrested and murdered in Memphis Shelby County Jail in 2003, and I have gotten nothing but lies, terrorism, and censorship ever since. Dear Georgia MoveOn member,

You previously signed a petition to get justice for my father, Kenneth Chamberlain, Sr. I need your help again, this time for the justice at the federal level.

On November 19, 2011 68-year-old Kenneth Chamberlain, Sr. was shot and killed by members of the White Plains Police Department. He accidentally triggered his life-aid pendant, which he wore around his neck because he suffered from COPD and a mild heart condition. He had committed no crime.

Although the officers mocked, taunted, and used expletives (including the word 'nigger') to distract my father, the City of White Plains refused to indict the officers for misconduct in the fatal shooting. The Attorney General should initiate an investigation into the officers involved as well as the White Plains Police Department.

That's why I created a petition on SignOn.org to Chief of the Civil Rights Unit of the Southern District of New York David J. Kennedy, U.S. Attorney Preet Bharara, Assistant Attorney General Thomas E. Perez, and Attorney General Eric H. Holder, Jr., which says:

We, the undersigned, agree and stand in solidarity with the family of Kenneth Chamberlain Jr. in demanding that Eric Holder do the right thing and indict these officers for violating the civil rights of Kenneth Chamberlain Sr. We urge you to also place the White Plains Police Department under federal review.

"White Plains police acted with reckless abandonment and demonstrated a chilling disregard for the quality and sanctity of the life of Mr. Kenneth Chamberlain. Indeed, and at best, the White Plains Police Department violated both their mission statement and their sacred oath of office by facilitating the death of Mr. Chamberlain," stated Jimmy Bell, Department of Criminal Justice & Sociology, Jackson State University.

Please endorse my petition on "We the People" at White House.gov: PROSECUTE TUSKEGEE EXPERIMENT MURDERERS. The Tuskegee syphilis experiment (also known as the Tuskegee syphilis study or Public Health Service syphilis study) was an infamous clinical study conducted between 1932 and 1972 in Tuskegee, Alabama by the U.S. Public Health Service to study the natural progression of untreated syphilis in poor, rural black men who thought they were receiving free health care from the U.S. government. [Wikipedia]. After World War II, racists who killed Jews in medical experiments and other atrocities were prosecuted and sentenced to death or imprisonment for their crimes against humanity. Many of these criminals were elderly when they were captured. Persons who tortured/killed Americans during 40 years of deadly experiments in Alabama deserve prosecution. There's no statute of limitations on murder.

If you agree that rural black men, their wives and children who the U.S. Government infected with syphilis deserve justice, please endorse and share the petition. Everyone who participated in this Nazi experiment deserves prosecution and punishment. Just as it was with Nazi war criminals, it is not acceptable to say, "I was just following orders" when it comes to causing death and disease. Syphilis was already understood to cause insanity, blindness, body sores, sterility, and death before the disease was inflicted on innocent black men who trusted their bodies to the United States Department of Health.

Today, employees at certain large corporations are being forced to accept vaccines and/or microchips or face termination. Americans are being forced to relinquish free will over their own bodies and their children's bodies. In 2009, Massachusetts passed a Martial Law bill providing for individuals who dared to refuse the H1N1 vaccine to be quarantined indefinitely in FEMA centers (concentration camps) if the government had declared a health emergency. Health care professionals, government administrators and corporations were all absolved of liability for any deaths or injuries that might have resulted from taking the H1N1 vaccines, even if the victims were forced to submit to the inoculation.

Thousands of Americans today complain about being victims of electronic harassment and other human experimentation (targeted individuals). Therefore, we must hold every doctor, nurse, and government administrator connected with the Tuskegee Experiments responsible for the injuries and deaths they caused. People who participate in crimes against humanity deserve punishment for torture and murders to the fullest extent of the law for what they did to unsuspecting, rural blacks decades ago. Please endorse this petition to demand justice for innocent people in Alabama who died a slow, torturous death, passed birth defects onto their children, and caused the deaths of their spouses. Federal Judge Rules Indefinite Detention UNCONSTITUTIONAL

More than 50,000 Demand Progress members signed up as grassroots supporters of a lawsuit against indefinite detention that was spearheaded by journalist Chris Hedges and the activist group Revolution Truth.  Well, less than 24 hours before tomorrow's vote on the NDAA, a federal judge has ruled in our favor, issuing an injunction that asserts that indefinite detention is unconstitutional.  http://www.bloomberg.com/news/2012-05-16/military-detention-law-blocked-by-new-york-judge.html A huge victory, for certain. I was so impressed with the zeal to enforce justice for pit bulls at Michael Vick's ranch that I penned this poem, wishing that certain people counted as much as dogs in America with their right to life, liberty, and pursuit of happiness protected like canine citizens. Laws are used to prosecute African Americans by the hundreds of thousands each year, but laws are seldom used to protect us:

Ppl invest many manhours building social sites then get 1st amendment rights violated. Some sites hate prisoners;others hate mental patients

World Day Against DP - Oct 10

October 10, 2011 is World Day Against DP.  I am against capital punishment, war without provocation, discrimination based on race and class in the justice system, criminalizing mental illness, and hypocrisy, especially among leaders. Below is a letter I received from Reprieve:

Dear Mary

This year's World Day Against the Death Penalty focuses on the inhumanity of the death penalty as a cruel, inhuman and degrading punishment.

 

Lethal injections are experimental and frequently botched – leading to an agonisingly painful death.

The first in the 'three-drug cocktail' is an anesthetic to put the prisoner to sleep; the second is a paralyzing agent to immobilize them; the third is a massive overdose of potassium chloride to stop their heart. If the first drug fails - often the dose is too low or the IV is not inserted properly - the prisoner remains awake, able to feel appalling pain but frozen in silence, paralyzed by the pancuronium. This is a botched lethal injection. The prisoner suffocates slowly until the potassium chloride shocks the heart so severely it stops beating. If the prisoner remains conscious at this point the pain is excruciating.

This is cruel, inhuman and degrading treatment. Reprieve's Stop Lethal Injection Project has been fighting to end the trade in drugs used for executions and so far has been successful in preventing supplies from Austria, Denmark, India, Italy, Germany and the UK from reaching US death rows. Today we have called on healthcare professionals to help us debunk the myth that lethal injection is 'humane'.

CoIntelPro often codes my first paragraph not to show on the cell phone view, so it is repeated above the photographs.  Unfortunately, anti-DP advocacy is highly censored. In July, cyberstalkers attacked my three Blogger blogs immediately after I published articles against Senate Bill 968, the IP Protection Act, a/k/a "Internet Censorship Bill." Google, a free speech hero, reinstated the blogs in the interest of freedom of press. Senate Bill 968 proposes putting the Internet under the U.S. Justice Department, which could end online advocacy against DP and other injustices.  Regarding capital punishment, the Bible says:  For He hath looked down from the height of His sanctuary; from heaven did the LORD behold the earth; to hear the groaning of the prisoner; to loose those that are appointed to death - Psalm 102:19-20.
