Troy Davis' Appeal Rejected by U.S. Supreme Court

1.  (2 links) The United States Supreme Court denied Troy Davis' Appeal.  Troy Davis' family and supporters and everyone who wants to end capital punishment in America or protest any other injustice should join the BOYCOTT 4 JUSTICE: No Shopping on the 9th of any month in 2011. 2.  (1 link)  This article is intended to better acquaint the world with Georgia courts that tried and sentenced Davis and denied him a new trial before his peers numerous times.  Apparently, Davis is considered "immaterial" like my family was ruled by the United States District Court, Northern District of Georgia in 2009.  Although this ruling is on record, I am censored and stalked for telling people about it just as Davis is not allowed to talk about injustices he endures.  It seems highly unlikely that any black man's death and his family's pain and suffering is "material" in Georgia courts.  The State Legislature enacted a new law in 2006 giving courts the power to prevent a black youth's death by police from going before a jury although the former officer had been indicted on murder charges by the grand jury.  See "Corey Ward - Police and Cochran Firm Victim" at this link:  http://freespeakblog.blogspot.com/2010/10/corey-ward-police-and-cochran-firm.html - Everyone indicted for murder has to stand trial by jury in Georgia except defendants judges choose to excuse.  Not only can wealthy people and police officers commit murder and escape capital punishment, but the new law provides that they do not even have to defend their actions before a jury.

4.  (2 links)  Unlike other inmates, Davis is under a gag order that prevents him from communicating with the press and the public about his innocence.  Amnesty International (AI) does a commendable job of defending Troy Davis and deserves gratitude and support from all people who care about human and civil rights. 5.  Many dignitaries and world citizens joined Davis and his family in protesting his execution on unproved allegations that he murdered off-duty Savannah police officer Mark Allen MacPhail.  It is wrong to execute anyone, particularly in the absence of irrefutable evidence of guilt.  It is wrong to issue a gag order to prevent a human being from saying, "I am innocent.  Listen to my evidence.  Please help me."  Therefore, for years I have joined thousands of others in speaking for Troy Davis, a man who is not allowed to speak for himself. 

6.  Excerpts from the Associated Press (AP) report below are followed by links to articles I published to give voice to a voiceless, innocent man on death row.  A brief summary of events that led to Davis' wrongful conviction are presented in my "Background on the Troy Davis Case." Although Davis' case has been reviewed by officials in the injustice system several times, he was always denied a new jury trial in a state where 37 inmates are reportedly missing.  The missing prisoners led a nonviolent inmate worker strike in December 2010 hoping to win a more humane incarceration.  Links to their story are also provided below the AP report excerpts herein.

7.  Prison profiteering is a thriving industry in the USA at a time when other industires are declining.  Roughly 1 in 13 Georgians is a prisoner, parolee, or probationer - significantly higher than the national average.  Unless the missing 37 Georgia prisoners are "found," there may be more dead inmates like my mentally, physically handicapped brother, Larry, who was arrested numerous times because his loud singing and panhandling irritated police.  This is the risk unless more Americans, including human rights organizations, protest Guantanamo-style brutality to inmates inside U.S. correctional facilities.

9.  (1 link)  Holley's allegations that ethical attorneys and most of Cochran's staff were forced out of the firm after his death because they refused to mistreat minority clients were proved by the way The Cochran Firm defrauded my family and others I report about in my blog - http://freespeakblog.blogspot.com/ .  Immediately after Larry's death, The Cochran Firm signed contract with the Neal family under a secret conflict of interest: The managing partner of The Cochran Firm's Memphis office was himself a Shelby County Commissioner and liable for the jail violating its Agreement with the USA regarding inmate intake procedures, care for sick and disabled inmates, and mandatory fatality reports.  The firm held the Neals' lawsuits regarding Larry Neal's negligence and murder under yet undisclosed circumstances out of court by secretly withholding all legal work which the firm lied and said was underway for 10.5 months of Tennessee's 12-month statute of limitations.  That was done to shield the jail from the Neals' lawsuit, federal investigation, and public outrage.  Both Shelby County Government and USDOJ continue to refuse to release records under federal subpoena or the Freedom of Information Act.  Only "slave class" people like Troy Davis and 2.3 million American prisoners are held accountable to the law in America, and many are punished for unproved crimes at significant costs to taxpayers while the real criminals walk among us and some preside over us.

10.  After The Cochran Firm saved Shelby County Jail by defrauding Larry's family, the injustice system then colluded to protect The Cochran Firm from the Neals' lawsuits regarding its fraud and malpractice by falsely declaring that the Atlanta office where our lawsuit was served to The Cochran Firm by Georgia Marshals is nonexistent.  This incredible ruling by Georgia Superior Court was made in 2006, and The Cochran Firm never stopped advertising and "representing" clients under that identity in Georgia, mostly blacks, Latinos, and Native Americans.  United States District Court in Georgia ruled in 2009 that The Cochran Firm's fraud against the Neals was "immaterial."  These are the same courts that Troy Davis pleaded with for a "fair day in a just court."  Like the Neal family, justice for Troy Davis was denied.

13.  Excerpts from Associated Press - Monday, March 28, 2011, by Greg Bluestein - ATLANTA — The Supreme Court on Monday rejected an appeal from a Georgia death row inmate who was given a rare chance to argue his innocence but failed to convince a federal judge that he was wrongly convicted of the 1989 murder of a Savannah police officer.

14.  The decision clears the way for state officials to move forward with Troy Davis' execution, but problems with the state's supply of a key lethal injection drug put the timing in doubt. Federal regulators this month seized the entire stockpile of the drug, sodium thiopental, amid questions about how the state obtained it. The move effectively put all executions in Georgia on hold.

15.  He's been scheduled for executions three times since 2007, but was spared each time by courts agreeing to take another look at his case. After Monday's ruling, though, even Davis' attorneys acknowledge his options are limited. Defense attorney Jason Ewart said the likeliest route is the Georgia Board of Pardons and Paroles, a five-member board that rarely postpones executions.

19.  The case has become a rallying point for death penalty opponents across the globe, attracting support from the National Association for the Advancement of Colored People, Amnesty International and dignitaries such as former President Jimmy Carter and Pope Benedict XVI. Several of Davis' supporters urged the pardons board to commute his sentence.

I have no idea what taxpayers are paying to defend Gonzales on his prison profiteering indictment. Justice in America is too skewed to benefit the rich for this country to ever execute anyone.

"It's God that carried me through death's valley and took my worries away."

For Davis, faith is the door to freedom. "Having faith makes you stronger than your family and able to support them more than they are supporting you," he said, "because they are the ones who will be left behind once you are gone and you have to show them you are not afraid to die."

"Sometimes all of this seems like it's happening to someone else. I sometimes dream to be free, but in each dream my family is 18-and-a-half years younger, and my father is still alive," said Davis during an in-person interview in April 2008.

"I am disappointed at the system, but refuse to become bitter and angry, because I still have a lot of fight left in me . Please do the right thing. Grant Troy Davis a new trial. It is not so hard to be just in life. It is a simple matter of doing unto others as you would have them do unto you. Just be fair. No more lynching. After nearly two decades on Georgia’s Death Row, please grant this American his simple request for “a fair day in a just court.”

Just Shut Up and Eat Yo Chicken."  If the survivors ask for records and explanations, they might be ignored by authorities, censored by mainstream media and online companies, have people move in houses around them to monitor their movements and take over their computers via remote access, and get threats by phone and email.

I believe half of Wisconsin must be on a watchlist by now for protesting attacks on unions. Dr. King was on watchlists. Probably thousands of students are on the watchlist for protesting reductions in financial aid, especially Georgia students who protested at the State Capital about cuts in the Hope Scholarship.  Amnesty International probably made the watchlist long ago for protesting executions.  I have tremendous trouble posting any news about executions.  Peace advocates are on the watchlist for protesting wars in the absence of preemptive force.  Environmentalists are on the watchlist for trying to protect our forests, rivers, and streams.  After a while, the only people not on the watchlist are going to be those who make the watchlists.  Protesting anything at all that elitists make money from will put Americans on the watchlist.  Boycott 4 Justice: No Shopping on April 9 and the 9th of any month throughout 2011.  The shopping moratorium is the people's 9/11 emergency response to corporate greed and government misdeeds.  Link:  http://freespeakblog.blogspot.com/2011/03/boycott-4-justice-no-shopping-april-9.html - Americans hold rallies, march, sign petitions and make impassioned pleas about problems, but it is time to use our collective strength as consumers in a protest that will affect profits, since profits are prioritized over people.


Newsvine need not worry.  I will not try to post anything with that service again.  Their slogan is "Get Smarter Here."  That depends on what people who use the service want to learn about, apparently.  Certainly, news about secret arrests and murders of handicapped American citizens is taboo as well as the imprisonment of 1.25 million other mentally challenged Americans and immigrants. Obviously, the company feels that I overstepped my "boundaries" by asking for records and justice after the SECRET ARREST AND WRONGFUL DEATH OF LARRY NEAL and advocating for other acute mental patients in America to be treated in hosptials and community care programs rather than imprisoned. I am on Newsvine's Watchlist, and its employees have been told to "ignore this author."  I suppose that means my posts go to a set-aside area or get a denial of service.  I certainly seeded more than one article there, but where are the others?  The article at the Newsvine link is one in a series I wrote protesting enforced H1N1 vaccines. Even doctors and nurses protested when they were told to take the shots or lose their jobs in 2009. They sued because they did not feel the drug was proved safe and that their bodies were their own, not government property.  But we are not to object to the mentally ill who are locked away in prisons being administered shots that medical professionals reject.


America invades countries when officials commit human rights violations against their citizens, but I am censored, stalked, and persecuted for asking, "WHAT HAPPENED TO LARRY NEAL" and trying to give ASSISTANCE TO THE INCARCERATED MENTALLY ILL by asking that mental illness be decriminalized in this country.  We do that by making people aware of the problems acute mental patients and their families face when they seek treatment, and we always direct the public to write, call, and email their representatives and request that mental patients be hospitalized or treated in community care programs.  That is all.  Why would that put an American on anyone's watchlist?


Americans' right to free speech and freedom of press and the right to petition government for a redress of grievances are under attack for many people and completely gone already for others.  What happens to my family as we pursue justice for Larry Neal that is equivalent the efforts that Michael Vick's dogs received is evidence of that fact.  Mentally ill citizens, especially black ones, and their families are deemed less worthy of justice than pit bulls.  Roughly 1.25 million mentally ill people are presently imprisoned, and that is exactly where they are intended to stay, and many more will join them when soldiers suffering acute PTSD arrive home.  Advocacy to treat rather than punish mental illness negatively impacts prison profits.  That is why I am censored, stalked, and treated worse than a dog in America for asking mercenary people to please be fair.

Legacy of Hatred

19 paragraphs, 1 photo, 6 links. They blacked out the parts of this blog reminding my readers that whites like Cameron Todd Willingham and Thomas Arthur also suffer wrongful convictions and executions. They blacked out my reference to Brandon Rhode, a white young man recently executed in Georgia using faulty anesthesia to ensure his agony. I deleted some of the cyberstalkers' codes to make it visible. The 18th paragraph begins "It is time for everyone who is fed up to stand up together," and the final paragraph begins, "Please Google 'Mary Neal' with the names of inmates or circumstances that interest you."

Judge Sherling Schrock's Legacy of Hatred

The struggle for racial equality suffered a serious blow this week (March 21, 2011) in Berrien County, Michigan, and the public was treated to a graphic depiction of pure unadulterated discrimination in the very place where racial and/or class origin should impact least:  The courts of so-called justice in which punishments are supposedly tailored to fit the crime, not the race of the offender.

On the very same day Judge Sherling Schrock sentenced two young men convicted of murder.

One was a young white man who attacked and bludgeoned to death his mother's boyfriend while the man slept. The crime seemed brutal, premeditated and gruesome as the defendant used his fists and knees to batter this man to death. This young man received no prison sentence but instead was put on probation for three years because as Judge Schrock stated, "In my estimation, prison does not help anybody. People come out of prison worse not better...and that this young man would be better served by the close monitoring probation provided."

The other sentencing involved three black teenagers who were at the scene when a white robbery victim was murdered for a small amount of cash. The very same Judge, Sherling Schrock, sentenced Dequarius Steward (though he had never been in trouble with the law before) to life in prison. The other two teens, Kanisha Dyer and Lavor Coates-- who were not accused of the murder itself-- were given ten year and fifteen year sentences respectively as accomplices. Lavor said he had argued with Steward not to hurt the man and Kanisha had the misfortune of just being present at the scene. Apparently the real "crime" all three of these teenagers committed was being born black and poor in a county run by ruthless rich white people who can openly flaunt their power to favor one racial group over another.

There are many losers in this story, the first being the young people whose chance for any decent future was crushed under the wheel of this "justice" and of course, the families who will lose a child into the maw of incarceration that will very likely destroy them. The society which will have to live with these bitter and dehumanized adults as they emerge from their "just" imprisonment will also, no doubt, bear a huge cost. And of course, the other losers are those who have worked hard for justice and racial equality only to see their cause mocked and discarded so casually by judges such as Sherling Schrock.

Actions such these sentences by Judge Schrock build a legacy of hatred for which all our children will pay a huge price, one way or another.

Rev. Pinkney, you asked for this news to be forwarded widely, and I agree that it needs to be read by millions.  I have no better example than Judge Schrock's disparity in sentencing to evidence racism in the injustice system other than my own family's tragedy.  My mentally, physically disabled brother, Larry Neal, was secretly arrested and murdered, and his lynching was covered-up by United States Department of Justice, Memphis/Shelby County Jail and other County officials, and The Johnnie Cochran Firm was engaged to defraud my family as our wrongful death attorneys to prevent the crime from being aired or punished.  I published the news online, including in my blog http://FreeSpeakBlog.blogspot.com (Google "Cochran Firm Fraud")

Thank you for providing the injustice in Berrien County, Michigan as evidence that miscreants in America seek to return the country to slavery via the injustice system.  Although Judge Schrock's rulings seem obviously prejudice based on race, many whites were also excessively sentenced in recent years, and some face execution who are innocent.  Being white helps people stay out of prison, but once there, race seems not to matter as much. 

Cameron Todd Willingham, a wrongfully convicted white man in Texas, was executed for murdering his children via arson after authorities received the fire report indicating there had been no arson and therefore no murders. In September, Georgia executed Brandon Rhode, a 32-year-old brain damaged white man who was condemned to death at age 18.  Rhode's death was particularly horrendous because the State used faulty anesthesia that ensured Rhode died in agony.  In July 2009, Thomas Arthur, a white man on Alabama's death row, received DNA test results indicating that he is not guilty of the murder for which he was sentenced to die.  The judge immediately sealed Arthur's DNA results to prohibit Arthur's lawyers from releasing the results to the public, and an Alabama District Attorney said he would pursue Arthur's death warrant. 

It is a great tragedy that mainstream media had followed Arthur's quest for DNA tests to prove his innocence for many years (like the media followed Troy Davis' quest for a new jury trial), but when Arthur's DNA test results indicated that the man was wrongfully convicted, no mainstream media reported the truth, and Arthur yet sits on death row where he has been for almost 30 years.  Definitive DNA tests have been available for at least two decades, but Arthur was constantly denied the opportunity to test his DNA against the evidence at the crime scene to prove his innocence.  When he finally was allowed to do that and the results came back showing the injustice system had failed, they hid the failure and plan to kill Arthur anyway.

The prison industrial complex makes the same amount of money whether inmates are black, white or other, and whether inmates are innocent or guilty.  Condemned people and inmates with acute mental or physical handicaps are worth substantially more to prison investors.  Prisons charge taxpayers for treatments and accommodations that the sick inmates are often denied.  According to the Death Penalty Information Center, each death row inmate costs $90,000 per year more than containing the prisoner in a maximum security prison.


Corporate greed is monstrous, and it is why America is spiraling downward.  Literally everything that is going wrong benefits corporate interests:  wars, prison growth, outsourcing jobs overseas and to prisons, criminalizing mental illness, weakened environmental protection laws, attacks on unions, the death penalty - everything!  Tough new immigration laws are designed to render illegal aliens to prison rather than back to their countries in order to have more inmate laborers at taxpayers' expense to replace "free" Americans who need jobs.


It is time for everyone who is fed up to stand up together in a peaceful protest against corporate greed and government indifference.  The BOYCOTT 4 JUSTICE is the people's 9/11 response - a shopping boycott on the 9th of each month throughout 2011.  Use the shopping boycott to RESIST whatever injustice you protest.  All injustices ultimately have the same cause - corporate greed and government indifference.  Americans must unite and demand respect as customers, constituents, and most of all, as human beings.

People must donate more funds and time to organizations that advocate for the people.  If not, loyalties are subject to Change. The NAACP petitioned Congress in autumn 2010 to outlaw menthol cigarettes, the type that is smoked by 80% of black smokers. White smokers would not be impacted in significant numbers.  This would expand the expensive War on Drugs by discriminating against blacks like the controversial power v. crack cocaine laws do.  According to the National Center on Addiction and Drug Abuse at Columbia University, federal, state, and local governments spent $467.7 billion regarding substance abuse in 2005. There is obviously a plan (that is working so far) to return to slavery via the injustice system. PEW statistics indicate that 1 in 99 Americans is behind bars.  In Georgia, 1 in 13 people is in the system either as prisoners, parolees, or probationers. Roughly 1.25 million mentally ill people of all races are incarcerated, although they should be in hospitals or community care programs (depending on their offenses and functionality). Incarcerating 2.3 million Americans and immigrants costs taxpayers $50 billion per year (up to $300 billion per year when factoring in police services, court costs, and lawyers for indigent people).  It behooves all people who care about freedom and justice, no matter what race, to protest elitists using the justice system to return America to slavery. Prison profiteers earn many billions more per year by supplying inmates for work projects for federal and state governments and private companies, including former union jobs.  In January 2009, Rep. Alcee Hastings (D-FL) introduced H.R.645 to expand America's prison system by erecting six (6) concentration camps for "crimes" such as refusing to accept government-mandated H1N1 vaccines (according to the Massachusetts Martial Law Bill that was passed in October 2009). On December 31, 2011, the president signed the National Defense Authorization Act (NDAA) making it legal to incarcerate people in military concentration camps without levying any criminal charges. The people will be denied any opportunity for defense. Please support H.R.3785 to repeal the concentration camp bill, and beware:  The plan to enslave the masses is not limited to minorities this time. Read Revelation.

I’ve been working on issues of police accountability, locked-up youth, violence, and community investment for a long time. Sometimes I think that no example of injustice could still surprise me. I was recently proved wrong by the Corrections Corporation of America (CCA).

The CCA recently invited cash-strapped states to sell them their prisons. Incarceration for profit is just plain wrong. Making a business from other people’s suffering is wrong. And demanding that states guarantee their for-profit corporation chock full prisons is immoral. It's clear that private lock-ups have zero incentive to end the revolving door of incarceration as long as they can reap millions in profit from overcrowded cells.

Our country needs to invest in businesses and industries that, in turn, invest in our people, create real jobs and help to build a future we can be proud of. Join me in calling on CCA to immediately rescind its 90% clause from any future contracts with states. And to publicly agree that their future contracts and bids will not include occupancy clauses. Let’s not allow the CCA to put their profits ahead of the health and well-being of our people and communities any longer.

Injustice Wears a Tan

Leonna's son, John A. Diaz, is a young man who was sentenced to life in prison for murder.  Judges and juries sentence defendants to prison based on evidence presented at trial unless a plea bargain is arranged based on a confession.  Judges and juries do not sentence defendants to torture.

It is the job of the United States Department of Justice to protect institutionalized persons.  However, the Justice Department reneges on that responsibility regularly.  In Georgia, 37 inmates are reportedly MISSING after conducting a nonviolent inmate labor strike in December 2010 that thousands of black, white, and Latino prisoners participated in hoping to win a more humane incarceration.

In 2003, my mentally, physically disabled brother, Larry Neal, was SECRETLY imprisoned for 18 days until death under circumstances that the USDOJ and Memphis Shelby County Jail illegally prevent his survivors from knowing.  "YES, WE KILLED LARRY NEAL.  SO WHAT?  HE WAS ONLY A MENTAL PATIENT, AND A BLACK ONE AT THAT!"  Instead of OBEYING THE LAW, the injustice system actually allows or facilitates stalkers online and in person to persecute my family for daring to ask for information and records on the secret murder of a disabled American in a case that The Johnnie Cochran Firm was supposed to help cover-up forever.  That is not democratic, but Nazi.

Knowing all to well how criminal some of the people are in the justice system, I share Ms. Brandao's letter with my readers.  I know very little about the allegations.  I only know that this injustice system in the United States of America is cruel, racist, extremely class-conscious, heartless, and criminal.

Conspirators in my brother's murder cover-up insist on his family joining the cover-up and that we stop sharing the news with the public.  However, when people want CONFIDENTIALITY AGREEMENTS, they must arrange same under due process of law, not by burning crosses in black people's yards.  Yes, there are those who believe they will turn back the clock to the 1940s when black men's torture and lynchings were  ignored because of fear by other blacks and apathy by the rest of America.  I beg to differ.  WE WILL NOT GO BACK!  We are not dissuaded from the fight for justice if injustice wears a tan.  There is a song we used to sing as we marched in the 1960s and 70s:  "Ain't nobody gone turn me 'round, turn me 'round, turn me 'round; Ain't nobody gone turn me 'round - 'cause I am freedom bound!"  

After reading Ms. Brandao's letter, please help her if it is in your power to do so.  Please pray for her and her son. I have talked with her numerous times, and she is a sister in Christ.  Her letter is boldly addressed to people who took an oath of office to honor the Constitution.  All American officials do that, but some did not mean it or they have become weary in well-doing and joined oppressors. Some people in law enforcement and high justice offices are probably repulsed by the things they are asked to do.  In these Last Days, it is time to choose sides.  (Exodus 32:26)  

It is time for America to stop hiding human rights abuses and address them with the sense of justice that it fights to enforce on tyrants in Iraq, Libya, and perhaps soon in Iran.  Although Ms. Brandao's letter is bold, I know from our conversations how crushed she is.  Many times while I stood boldly for the incarcerated mentally ill, my knees were trembling and tears streamed from my eyes as I read another terroristic threat cyberstalkers sent to my email boxes, or when I arrived home safely by God's grace after being followed to my destinations.  All soldiers know it is possible to act courageously while one feels terrified.  Ms. Brandao needs your prayers and support, and so do I.  Please help her son if you can.  America must stop torturing and killing prisoners.  As my grandma used to say, "God don't bless no mess."

Dear Governor Patrick and Commissioner Spencer:

Advocates who have been following the case of John Anthony Diaz are very concerned about two recent suicide attempts, by John A. Diaz, (first time offender serving a life without parole sentence).  It is of great concern that there may be a conspiracy against Mr. Diaz and that xxxxx [a prison official] is at the forefront of this conspiracy.

I have in my possessions numerous denied request and grievances for medical assistance, filed by John A. Diaz to no avail. Anthony Mendonsa (Mendonca), Deputy Superintendent of Classifications stated in a letter to an advocate that Mr. Diaz’s medical issues have been addressed. How can Mr. Diaz's medical issues be addressed when the Doctor, Health Care Administrator, Bonnie Werner and Marlene Dodge have all denied every request by Mr. Diaz. Nurse Practitioner Mark Schnable, approved a physical therapist following calls to the prison and allowed that to stop before the approved time without a notice to the patient and not long after Mr. Diaz's attempted suicides.

If this individual’s medical and psychological needs have been met, I would like to know the name of the DOCTOR, WHEN he was seen and HOW he was diagnosed? Mr. Diaz was placed on medication for pain for a brief period of time for pain in his legs. Yet, AT NO TIME was he SEEN by a DOCTOR to date. How can a doctor give medication to an individual he knows nothing about? An individual that may have allergies or other serious results from certain medications without first being seen.

Moreover, following two attempts at taking his life, due to ongoing provocation, denied request for medical and psychological help, ongoing harassment by xxxxxxxxxx  and certain staff he obviously has control over and in spite of the severity of John's emotional state and unmet needs, he was assigned a mental health worker. It was then and ONLY THEN; THAT he was seen by any mental health provider. I would also like to add, that I trained with the MA Dept. of Corrections as a mental health worker and in no way, was a mental health worker qualified to provide psychological treatment. Especially to a prisoner whom throughout the past fourteen years, been seriously abused and deprived. Therefore, I would like to know the name of the Psychologist who approved the mental health worker without seeing the patient. The Psychologist/Psychiatrist who saw Mr. Diaz following his two attempted suicides. What were the dates he was seen and what was his diagnosis for this individual, Mr. Diaz who obviously was so depressed, he tried to take his own life twice. Would you consider John Diaz to have had his medical or psychological needs met? Can anyone ensure that this young man is psychologically capable of being double-celled at this time? Moreover, while still in an unstable and sensitive state, John Diaz was again forced to double-cell.

Mr. Diaz, while handcuffed, was forced to double-cell with another inmate. Because he refused and started to fight the other inmate while still handcuffed, he was taken off to another area of the prison, by four guards (specifically xxxxxxxxxx) and three others (names unknown) and beaten. He was then placed in Solitary Confinement where he remained until recently. My first visit with John A. Diaz after almost a year, was devastating. John had a cut over his right eye, swelling over the his left eyebrow and a bruised and swollen lip. Letters were sent out and the Governor's Office called the prison. The investigator, who knew and liked some of the individuals he was to investigate, suggested to Mr. Diaz that maybe he did it to himself and when asked by Mr. Diaz to view the video for proof, the investigator stated the videos are destroyed after two weeks which is not true and is also illegal. The internal investigation went nowhere. This again, causes concerns for a CONSPIRACY .

John A. Diaz received a letter which I have in my possession, from Peter Heffernan, Deputy Director of Health Services Division, regarding his denied request and appeal to have medical assistance. The letter was another letter of DENIAL, stating that the altercation that took place on January 4, 2011 showed his abilities to function within normal limits. The altercation which took place on that night was the assault by four guards when Mr. Diaz again, could not cope with being double-celled and panicked when forced to double-cell. Although that has not solved his ongoing medical and psychological needs. It only proves that this patient is in dire need unaddressed medical and psychological treatment.

Be aware that 2.3 million Americans and immigrants are incarcerated, and over half of them were convicted for nonviolent offenses.  Some are innocent, as proved by over 400 inmates whose convictions were overturned with new evidence in recent years.  American prisoners include roughly 1.25 million mentally ill people who should be hospitalized or released (if nonviolent) into community care programs.  Prisons are for public safety, punishment, and rehabilitation - never torture (Hebrew 13:3).  Ms. Brandao's contact information follows.  I hope that visitors at MaryLovesJustice blog will contact her and offer comfort and assistance.  See the video below of Dr. Martin Luther King, Jr., after which, the article continues.

Miami Police Dept. Under Investigation After Killings of 7 Black Men in 8 Months This is a sobering story in the New York Times that's worth a fuller read. Apparently, the Miami police department is under scrutiny after a series of fatal shootings by officers on the job: A major meeting is being held today to discuss the issue, which has inflamed racial tensions. It hasn't helped that clips from an unmade pilot reality TV show featuring the cops has surfaced online, featuring them describing themselves as "predators" who "hunt" for suspects: Mr. McNeil was the seventh African-American man to be shot and killed by Miami police officers in eight months. The shootings in this racially polarized city have led to marches on the Police Department’s headquarters and calls for a Justice Department investigation, and the city manager has initiated an investigation into the chief’s record. After pushing for action for weeks, the families of the seven shooting victims will speak at a City Commission meeting on Thursday. Some families are demanding that Chief Exposito be dismissed. Police officers, security and prison guards, and all who have the means to kill or abuse people under the color of law must exercise proper restraint and honor human and civil rights laws. Such persons have the ability to commit such egregious offenses that they could disrupt domestic peace. This makes it important for the U.S. Department of Justice and other officials to ensure that persons who are equipped with guns, Tasers, and other weaponry and represent law and order in any capacity should have proper training and operate with the understanding that there will be zero tolerance for abuses of power. There should be no opportunities to dodge accountability if they act illegally in their official capacities. Accountability equals homeland security. As Dr. King said, "No justice, no peace."
