Remembering Justice Scalia


"Black people don't belong in academically challenging schools," is how some people construed Justice Scalia's statement regarding affirmative action. We are going to miss that man! May the Lord have mercy on his soul and console his family and close friends.

In his own way, Justice Scalia was something of a truth-teller. It was Scalia who revealed how little innocence matters in this very criminal justice system. In dissenting from the Supreme Court's decision in 2009 to allow Troy Davis another hearing, Scalia said, "This Court has never held that the Constitution forbids the execution of a convicted defendant who has had a full and fair trial but is later able to convince a habeas court that he is ‘actually’ innocent. Quite to the contrary, we have repeatedly left that question unresolved, while expressing considerable doubt that any claim based on alleged ‘actual innocence’ is constitutionally cognizable."

Scalia’s fellow justices noted that his position allows no legal avenue for even an obviously innocent person to have his or her case heard, including condemned people facing imminent execution. Frankly, the United States has thousands of "obviously innocent" people behind bars and more being incarcerated continually. Wrongful convictions are common, primarily among mentally ill citizens, people of color, and poor whites. Excerpt from "Judge Anderson vs. Michael Morton: Wrongful Conviction": America wrongfully convicts from 5k to 10k people per year, mostly people who are black or poor. The USA keeps these inmates throughout their childbearing years to use them as slaves and for eugenics (to prevent population growth among "undesirable" populations of people, such as blacks). Around the age when people would normally retire, the injustice system may finally admit its mistake and release a few each year (mostly senior citizens). That way the public is convinced the system really cares about innocence, although it does not. The game is eugenics and slavery while promoting the illusion of inclusion.

Truth-teller Scalia honestly affirmed that internment of American citizens on our own soil by the government would likely happen again as it did to the Japanese during WWII. Scalia was responding to a question about the court's 1944 decision in "Kore­ma­tsu v. United States," which upheld the convictions of Gordon Hira­ba­ya­shi and Fred Kore­ma­tsu for violating an order to report to an internment camp. "Well, of course, Kore­ma­tsu was wrong. And I think we have repudiated in a later case. But you are kidding yourself if you think the same thing will not happen again," Scalia told University of Hawaii law students and faculty during a lunchtime question-and-answer session in 2014. "In times of war, the laws fall silent." Lawlessness is attractive to elite white supremacists.

Justice Scalia was such a colorful conservative. He inspired satires about threats to resign should gay people win the right to marry. He was also quite prolific. Scalia reportedly wrote more concurring opinions than any other justice, and only two justices have written more dissents. Scalia described himself as an originalist, meaning that he interpreted the Constitution of the United States as it would have been understood when it was adopted. According to Scalia in 2008, "It's what did the words mean to the people who ratified the Bill of Rights or who ratified the Constitution." One thing is clear: The forefathers certainly did NOT mean liberty and justice for ALL - Africans and Native Americans were absolutely excluded from the rights declared in those documents in minds of the men who framed them; so one might presume that Scalia, as an originalist, concurred.

Justice Scalia's truth-telling was his most special quality (I am not saying that "his" truth was always "the" truth, you understand). It is important to know how one's opponents think. Justice Scalia exposed the conservative mindset more honestly than most political figures, and he did it so efficiently. I have spent at least a decade online attempting to inform Americans and the world about this nation's decline into Nazism, which became evident when I realized the government's discrimination against mentally ill people. They are generally treated as being exempt from the "right to life" principle regardless of their race and socioeconomic status. That is also where Germany began its campaign to rid that country of undesirables in the 1930's. The Jewish Virtual Library relays that roughly 300,000 persons labeled as being mentally ill (ages 2 to elderly) were exterminated before targeting Jews, Blacks, homosexuals, and dissidents. I may have written a million words on the subject, but Justice Scalia summed up the problem in 2013 using just one sentence: "The Constitution is dead, dead, dead!" That truth-telling from a U.S. Supreme Court justice affirmed my decade of articles, emails and radio broadcasts in just six words.

Long ago, I would listen to Rush Limbaugh to learn what conservatives were thinking until I found Justice Scalia. For that, we will miss him. I can think of no reason at all why we will miss Clarence Thomas, but some corporations might. Maybe without Justice Scalia to partner with, Thomas will go ahead and retire and give us the chance to learn what life can be like without the dynamic conservative duo on the U.S. Supreme Court.

Justice Antonin Scalia was a man who had humor, wit, and uncommon honesty. It should now fall to President Obama to choose his successor, but that may not happen. It would be unusual for the Supreme Court to have a vacancy for a lengthy period of time, but political commentators anticipate the Republican-led Congress will refuse to confirm a new justice until after the election. Once Obama leaves office, Scalia's replacement would be decided by a president who is a fellow conservative, unless, of course, Senator Bernie Sanders wins. #feelthebern

On June 15, 2012 my brother Charlie Salinas was gunned down like a dog by officers of the Sanger Police Department and Fresno County Sheriffs Department. He was depressed, drunk, and suicidal. He made a 911 call saying he wanted to die. Sanger Police Department obliged him. They surrounded him, and opened fire shooting at least 30 times, even shooting him as he lay on the ground dying.

Prisoner Advocacy Offered: Human Rights for Prisoners March

ADVOCACY OFFERED. If denied justice in courts, take your justice quests to the court of public opinion through our "Human Rights for Prisoners March" across the Internet. My efforts are greatly censored, but we persist and eventually prevail in making the masses aware of the crimes against humanity that continue in the United States. Advocacy can make a difference in whether your lawsuit prevails and the amount of your award. Advocacy is also needed for inmates who face or already experienced wrongful convictions  or execution and are pursuing appeals or clemency. Many prisoners require adequate medical services that are sometimes withheld, and they need people outside who will be their voice.

Government officials and Internet companies are deliberating on whether the Internet will be treated as a utility and charges demanded for the amount of time people use the Internet. I am sometimes online 20 hours a day, especially when someone for whom I advocate faces imminent execution. Officials are also deliberating on whether information on the Internet will enjoy greater visibility for a fee instead of all web sites being given equal access (net freedom). We must not be silenced for the lack of money. Therefore, services that MaryLovesJustice has given free for a decade now requires financial participation by the victims and families who benefit by our advocacy. The United States is a member of the United Nations and has signed certain treaties that it is accountable to uphold. See Executive Order No. 13107, wherein President Bill Clinton reaffirmed America's commitment to uphold the human rights of people in the U.S.A. According to International Human Rights Lawyer Mustafa Ansari, fewer than one percent of the complaints that the United Nations reviews originate in the U.S., although many crimes against humanity happen here. We plan to change that and submit cases of some victims and survivors for whom we advocate.


Americans must unite for justice. Our strength in numbers will reduce and eventually end police brutality, prisoner abuse, and executions. Millions of people who have no relatives or friends behind bars care about human rights for prisoners. Those who do have imprisoned and reentering relatives and all human rights advocates should join the "Human Rights for Prisoners March" across the Internet and demand respect for all. We will begin sending membership cards to supporters of this advocacy who send any amount of money to help. We must continually purchase new computers as ours are attacked by NSA or other cyber stalkers who seemingly work for prison investors.

Katrina Victim Needs Help in 2013


KATHERINE CONNER, currently residing in East Feliciana Parish, State of Louisiana, has applied for clemency for her conviction of Felony Theft. If you have any comments or wish to communicate with the Board of Pardons on her behalf, please call (225)342-5421. She is a Katrina victim who had a disagreement with an unlicensed contractor over her home repairs. When the contractor charged her $3,500 more than the contract, Katherine wrote a check and then cancelled it when she discovered the amount was more than the amount due, because the contractor refused to void the check accept payment in the correct amount. 

One thing led to another, and Katherine was accused of "theft of services." This gave rise to Katherine's one and only problem with the law in 52 years. She was ordered to pay $385.00 per month in probation and restitution fees out of her income of less than $600.00 per month, or face three years of hard labor. Katherine is presently being considered for pardon. Your phone call and prayers may make a difference. Many Katrina victims were unfairly victimized by unscrupulous contractors, and some contractors were prosecuted. It didn't work out that way in Katherine's case. For her, the storm never ended. Free Howard Morgan, Brutalized Black Policeman



Black police officers, many corrupt policemen consider you as nothing but target practice like other Africans in America. (Five links are in this censored article.) Former Chicago officer Howard Morgan was forced from his vehicle and shot 28 times by four white police officers. They left him for dead, but he lived by the grace of Almighty God. Then they lied and said Howard Morgan attempted to murder THEM. He was tried on this charge TWICE and found guilty at the second attempt. He was convicted and sentenced to 40 years in prison. We are asking that Mr. Howard Morgan be acquitted of ALL Charges

Howard Morgan, a former Chicago Police Officer before spending 13 years as a Railroad Police Officer for the Burlington Northern Santa Fe Railroad, pulled over on his way home the morning of February 21, 2005, because he saw a police car behind him and was letting it pass. To Mr. Morgan's surprise, he discovered that the police had stopped him for an alleged traffic violation. 

Though identifying himself as a police officer, Howard Morgan was forced from his vehicle and shot 28 times by four white police officers. 21 of those shots were administered to the back of Howard Morgan's body. An independent eye witness testified that Mr. Morgan never fired a weapon. A jury acquitted Mr. Morgan of the charge of aggravated discharge of a firearm. How then, could Howard Morgan, by any stretch of the imagination, be guilty of four counts of attempted 1st degree murder of the police officers who shot him?

When originally tried in 2007 for the Feb. 21, 2005 incident; Howard Morgan was charged with four counts of attempted first-degree murder, three counts of aggravated battery with a firearm and one count of aggravated discharge of a firearm.

In 2007, a jury acquitted Mr. Morgan of the two counts of aggravated battery as well as the count of aggravated discharge of a firearm. However, the jury was hung on the other five remaining counts; after which Judge Clayton Crane, the presiding judge, declared a mistrial.

The double jeopardy law, as outlined in the 5th Amendment of the U.S. Constitution, restricts government, by collateral estoppel, from re-litigating against the same defense a fact necessarily found by the jury in a prior acquittal, as in Ashe v. Swenson, 397 U.S. 436 (1970); even if the jury hung on other counts as in Yeager v. United States, 557 U.S. 110 (2009).

Therefore, Howard Morgan should never have been tried a second time in 2012. Not withstanding that fact; even the evidence in the 2012 trial was insufficient to sustain a conviction. Therefore the Court is compelled to enter a judgment of acquittal.

The destruction of evidence, withholding of evidence and lack of evidence gathered did not allow Howard Morgan the due process of law afforded him under the U.S. Constitution, 14th Amendment, and the State of Illinois Constitution, Article 1, Section 2; as he was not given a fair trial in 2007 or 2012.

Howard Morgan's van was crushed and destroyed without notice or cause before any forensic investigation could be done.

The State only produced 3 of the 28 bullets shot into and taken from Howard Morgan's body, whereby the rest of the 25 bullets could have shown whether or not the police officers who shot Mr. Morgan shot him with his own gun after taking it from him.

Howard Morgan was never tested for gun residue to confirm if he even fired a weapon on the morning in question.

The State never produced the actual bullet proof vest worn by one of the officers who claimed to have allegedly taken a shot directly into the vest on the morning in question. The State only produced a replica.

All of the above facts are a blatant obstruction of justice.

The 5th Amendment of the U.S. Constitution protects against "double jeopardy."

The 6th Amendment of the U.S. Constitution affords the right to a "speedy trial" by an "impartial jury." (being tried twice over a period of five years is not speedy.)

The 8th Amendment of the U.S. Constitution protects against "cruel and unusual punishment."

The 14th Amendment of the U.S. Constitution affords "due process of law."

All of the rights above, which are guaranteed Mr. Morgan by the U.S. Constitution have been violated by those representing the government which gave them to us.
On April 5, 2012, Howard Morgan was sentenced to 40 years in prison. He is currently being held at Dixon Correctional Center in Dixon, IL.

Former Chicago officer Howard Morgan was forced from his vehicle and shot 28 times by four white police officers. They left him for dead, but he lived by the grace of Almighty God. Then they lied and said Howard Morgan attempted to murder THEM. He was tried on this charge TWICE and found guilty at the second attempt. He was convicted and sentenced to 40 years in prison. NOVEMBER 2011 UPDATE on the Hank Skinner case: The U.S. Supreme Court gave Hank Skinner a last-minute stay of execution in March 2010. However, Texas continued to deny Skinner any opportunity to test his DNA against the evidence in the 20 months since the High Court spared his life. The 1% periodically kills potentially innocent people from the 99% like Troy Davis and Hank Skinner in order to keep the 99% feeling intimidated by their power. OCCUPY the phones and email boxes for decision makers to oppose capital punishment, especially for people like Troy Davis and Hank Skinner, whose guilt remains unproved. Stand up for 99% people being used to demonstrate the power the 1% exercises over life and death. This time, the order for the stay of execution should include a directive to TEST HANK SKINNER'S DNA. Troy Davis' Appeal Rejected by U.S. Supreme Court

1.  (2 links) The United States Supreme Court denied Troy Davis' Appeal.  Troy Davis' family and supporters and everyone who wants to end capital punishment in America or protest any other injustice should join the BOYCOTT 4 JUSTICE: No Shopping on the 9th of any month in 2011. 2.  (1 link)  This article is intended to better acquaint the world with Georgia courts that tried and sentenced Davis and denied him a new trial before his peers numerous times.  Apparently, Davis is considered "immaterial" like my family was ruled by the United States District Court, Northern District of Georgia in 2009.  Although this ruling is on record, I am censored and stalked for telling people about it just as Davis is not allowed to talk about injustices he endures.  It seems highly unlikely that any black man's death and his family's pain and suffering is "material" in Georgia courts.  The State Legislature enacted a new law in 2006 giving courts the power to prevent a black youth's death by police from going before a jury although the former officer had been indicted on murder charges by the grand jury.  See "Corey Ward - Police and Cochran Firm Victim" at this link:  http://freespeakblog.blogspot.com/2010/10/corey-ward-police-and-cochran-firm.html - Everyone indicted for murder has to stand trial by jury in Georgia except defendants judges choose to excuse.  Not only can wealthy people and police officers commit murder and escape capital punishment, but the new law provides that they do not even have to defend their actions before a jury.

4.  (2 links)  Unlike other inmates, Davis is under a gag order that prevents him from communicating with the press and the public about his innocence.  Amnesty International (AI) does a commendable job of defending Troy Davis and deserves gratitude and support from all people who care about human and civil rights. AI launched petitions to save Troy Davis, one of which is below in this blog and has resumed "Tuesdays for Troy Davis" protests in Atlanta. 5.  Many dignitaries and world citizens joined Davis and his family in protesting his execution on unproved allegations that he murdered off-duty Savannah police officer Mark Allen MacPhail.  It is wrong to execute anyone, particularly in the absence of irrefutable evidence of guilt.  It is wrong to issue a gag order to prevent a human being from saying, "I am innocent.  Listen to my evidence.  Please help me."  Therefore, for years I have joined thousands of others in speaking for Troy Davis, a man who is not allowed to speak for himself. 

6.  Excerpts from the Associated Press (AP) report below are followed by links to articles I published to give voice to a voiceless, innocent man on death row.  A brief summary of events that led to Davis' wrongful conviction are presented in my "Background on the Troy Davis Case." Although Davis' case has been reviewed by officials in the injustice system several times, he was always denied a new jury trial in a state where 37 inmates are reportedly missing.  The missing prisoners led a nonviolent inmate worker strike in December 2010 hoping to win a more humane incarceration.  Links to their story are also provided below the AP report excerpts herein.

7.  Prison profiteering is a thriving industry in the USA at a time when other industires are declining.  Roughly 1 in 13 Georgians is a prisoner, parolee, or probationer - significantly higher than the national average.  Unless the missing 37 Georgia prisoners are "found," there may be more dead inmates like my mentally, physically handicapped brother, Larry, who was arrested numerous times because his loud singing and panhandling irritated police.  This is the risk unless more Americans, including human rights organizations, protest Guantanamo-style brutality to inmates inside U.S. correctional facilities.

9.  (1 link)  Holley's allegations that ethical attorneys and most of Cochran's staff were forced out of the firm after his death because they refused to mistreat minority clients were proved by the way The Cochran Firm defrauded my family and others I report about in my blog - http://freespeakblog.blogspot.com/ .  Immediately after Larry's death, The Cochran Firm signed contract with the Neal family under a secret conflict of interest: The managing partner of The Cochran Firm's Memphis office was himself a Shelby County Commissioner and liable for the jail violating its Agreement with the USA regarding inmate intake procedures, care for sick and disabled inmates, and mandatory fatality reports.  The firm held the Neals' lawsuits regarding Larry Neal's negligence and murder under yet undisclosed circumstances out of court by secretly withholding all legal work which the firm lied and said was underway for 10.5 months of Tennessee's 12-month statute of limitations.  That was done to shield the jail from the Neals' lawsuit, federal investigation, and public outrage.  Both Shelby County Government and USDOJ continue to refuse to release records under federal subpoena or the Freedom of Information Act.  Only "slave class" people like Troy Davis and 2.3 million American prisoners are held accountable to the law in America, and many are punished for unproved crimes at significant costs to taxpayers while the real criminals walk among us and some preside over us.

10.  After The Cochran Firm saved Shelby County Jail by defrauding Larry's family, the injustice system then colluded to protect The Cochran Firm from the Neals' lawsuits regarding its fraud and malpractice by falsely declaring that the Atlanta office where our lawsuit was served to The Cochran Firm by Georgia Marshals is nonexistent.  This incredible ruling by Georgia Superior Court was made in 2006, and The Cochran Firm never stopped advertising and "representing" clients under that identity in Georgia, mostly blacks, Latinos, and Native Americans.  United States District Court in Georgia ruled in 2009 that The Cochran Firm's fraud against the Neals was "immaterial."  These are the same courts that Troy Davis pleaded with for a "fair day in a just court."  Like the Neal family, justice for Troy Davis was denied.

13.  Excerpts from Associated Press - Monday, March 28, 2011, by Greg Bluestein - ATLANTA — The Supreme Court on Monday rejected an appeal from a Georgia death row inmate who was given a rare chance to argue his innocence but failed to convince a federal judge that he was wrongly convicted of the 1989 murder of a Savannah police officer.

14.  The decision clears the way for state officials to move forward with Troy Davis' execution, but problems with the state's supply of a key lethal injection drug put the timing in doubt. Federal regulators this month seized the entire stockpile of the drug, sodium thiopental, amid questions about how the state obtained it. The move effectively put all executions in Georgia on hold.

15.  He's been scheduled for executions three times since 2007, but was spared each time by courts agreeing to take another look at his case. After Monday's ruling, though, even Davis' attorneys acknowledge his options are limited. Defense attorney Jason Ewart said the likeliest route is the Georgia Board of Pardons and Paroles, a five-member board that rarely postpones executions.

Several of Davis' supporters urged the pardons board to commute his sentence.

Compare that to the $24,000 each month that taxpayers are paying to defend former Attorney General Gonzales against a civil suit brought by lawyers who allege he kept them out of the USDOJ because they were not Bush supporters. I have no idea what taxpayers are paying to defend Gonzales on his prison profiteering indictment. Justice in America is too skewed to benefit the rich for this country to ever execute anyone.

Another Stay of Execution for Troy Davis - New Trial Please? http://www.nowpublic.com/world/another-stay-execution-troy-davis-new-trial-please  ~ Excerpt from an interview with Troy Davis  - PTBB News - "My faith has taught me that if you give all your worries to God he will carry your burdens," Davis wrote in a letter to me sent the day after my visit. "It's God that carried me through death's valley and took my worries away."

For Davis, faith is the door to freedom. "Having faith makes you stronger than your family and able to support them more than they are supporting you," he said, "because they are the ones who will be left behind once you are gone and you have to show them you are not afraid to die."

"Sometimes all of this seems like it's happening to someone else. I sometimes dream to be free, but in each dream my family is 18-and-a-half years younger, and my father is still alive," said Davis during an in-person interview in April 2008.

"I am disappointed at the system, but refuse to become bitter and angry, because I still have a lot of fight left in me . Please do the right thing. Grant Troy Davis a new trial. It is not so hard to be just in life. It is a simple matter of doing unto others as you would have them do unto you. Just be fair. No more lynching. After nearly two decades on Georgia’s Death Row, please grant this American his simple request for “a fair day in a just court.”

I am followed across the Internet and in person by stalkers to prevent advocacy for justice and compassion in America.  In fact, my Twitter page is not permitted to open on Atlanta City Library computers to prevent minority citizens from knowing about The Cochran Firm Fraud - http://twitter.com/koffietime , and making plans on my tapped phone to pass out flyers at the 2011 Black History Parade in Atlanta in February may resulting in the parade being canceled at the last minute.  Yet, I continue my Human Rights for Prisoners March online and will increase public picketing despite being threatened by Atlanta Police in June 2010 to arrest me for telling the public about the secret arrest and murder of Larry Neal and The Cochran Firm Fraud.  Hopefully, minority people will learn from my family experiences that having blacks in positions of power in the government means nothing; abusers of power come in all races.  I live in Atlanta, a city with people famous for civil rights activism who do nothing to curtail my censorship and gangstalking that ensured after suing The Cochran Firm for its fraud and starting my Human Rights for Prisoners march.  Prison profiteering has spread throughout America like an airborne disease, and many "leaders" are modern slave traders through their stock holdings.

30.  Either Americans have freedom of speech and press or we do not.  The fact that citizens have no protected right to life is proved whenever men and women are imprisoned or executed on unproved charges and by the secret arrest and murder of Larry Neal, a harmless lifelong schizophrenic heart patient.  The Constitution is rendered defunct by virtue of the fact that the judiciary and executive branches of government refuse to protect citizens' rights thereunder.  Indeed, the Constitution has been reduced to the status of antiquated laws like those dictating where citizens can tie their horses in city zones.
